Thank you for being part of TX-CERA’s Alliance for Response (AFR) community. Please read these Terms & Conditions carefully and in their entirety before using www.txcera.org (hereinafter referred to as the “Site”). The Site and its Contents are owned by Texas Collections Emergency Resource Alliance (TX-CERA).
These Terms & Conditions are established to clearly define, outline, and explain the conditions of using, viewing, and/or browsing the Site and/or purchasing any course, program, workshop, or service offered by us or on the Site.
Important Notes:
You must be at least 18 years of age to be able to consent to these Terms & Conditions. If you are under the age of 18, or you do not agree with these Terms & Conditions as stated, please STOP now and do not use this Site or its Contents.
By using the Site, you agree to act in accordance with and abide by the following Terms & Conditions, Privacy Policy, and Disclaimer.
Definitions:
“Organization”, “TX-CERA”, “We”, “Our”, or “Us” means Texas Collections Emergency Resource Alliance and www.txcera.org.
“Content” means any and all written, visual, video, or audio information contained on the Site, including, but not limited to, any and all emails received from TX-CERA or www.txcera.org, and any and all written or downloadable material purchased, viewed, or otherwise offered on www.txcera.org, such as blog posts, graphics, designs, documents, information, templates and materials.
“Personal Information” means information that can be used on its own or in conjunction with other information to identify, contact, or locate a person, or to identify an individual in context. For example, personal information could include: your name, address, email address, telephone number, job title, institution, credit card information, site behavior, etc.
“Site, Courses, and/or Services” means www.txcera.org, Content, email list, social media posts, blog posts, courses, forms, website materials, surveys, and/or contact through our emergency hotline.
“Site” means www.txcera.org and any and all of the Organization’s associated pages, tabs, landing pages, forms, or sub-pages.
“You” or “Your” means the user, customer, or viewer of the Site.
TX-CERA Disclaimer:
By using the Site, you understand that we are an affiliation of institutions and professionals that support and advocate for the preservation of Texas cultural heritage. TX-CERA promotes emergency planning followed by training in response and recovery efforts and techniques. Our Content is for informational and educational purposes only, and is based on personal and professional field accepted experience.
Changes to These Terms & Conditions:
We reserve the right to change, amend, or otherwise alter these Terms & Conditions at any time without notice to you. When changes are made, we will update the “Updated on” date at the bottom of this page.
Links to Other Sites:
Our Site contains links to other websites which are of interest to conservators, museum professionals, and professionals in fields related to disaster preparedness, response, and recovery. They may include third-party products, services, webinars, videos, templates, worksheets, or links to other articles, products, or sites. These sites may or may not have separate and independent privacy policies and terms and conditions. We are not responsible or liable for the protection and privacy of any information which you provide while visiting such sites. Nonetheless, we seek to protect the integrity of our Site, and welcome any feedback about any issues you experience with linked-to sites by emailing us at tx.cera@gmail.com.
Community Rules:
We value our professional community, workshop participants, members, and volunteers. To provide the best possible experience for everyone, we have established these rules and guidelines to govern our group discussions, workshops and training activities.
Be Respectful: We are here to create a welcoming environment for professionals to discuss the topic of emergency preparedness and response. Let's treat everyone with respect. Healthy debates are natural, but kindness is required.
No Bullying: Let's make everyone feel safe. Do not post any defamatory, abusive, profane, threatening, offensive, or illegal materials. Bullying of any kind is not allowed, and degrading comments will not be tolerated.
Respect the Purpose of the Community: We are here to support and advocate for the preservation of Texas cultural heritage. We welcome you to share information about projects or stories related to emergency planning, preparedness, response or recovery, but let's make this space free of self-promotion. Self-promotion, spam and irrelevant links are not allowed.
Share Feedback and Testimonials: You agree that TX-CERA has the right to use feedback whether in the form of comments or discussions for the purposes of marketing or promotion for future TX-CERA events, training courses or workshops.
TX-CERA reserves the right to terminate access to any user who does not abide by these guidelines.
Sharing Course Access & Its Contents:
You must request and receive written permission by email from tx.cera@gmail.com before sharing our Course Content for commercial purposes. You may share the information provided for personal or professional reasons, but we ask that you link directly to the Course or the Site.
Your Release of Us:
By using the Site or participating in TX-CERA’s Courses and/or Services, you agree to release, forgive, and discharge TX-CERA, it’s subsidiaries, employees, agents, trained volunteers, and affiliates from any and all claims, suits, actions, charges, liabilities, damages, and/or costs, whether known or unknown, both legal and equitable in any manner.
Errors & Omissions:
Although we do our best to maintain the Site and its Content, we do not warranty, guarantee, or represent that our Content or Site, Courses, and/or Services are complete, reliable or free of errors or omissions or that they pertain to your particular circumstance or recovery situation.
Payment & Purchases:
When purchasing one of our courses, we accept online payment. By doing so, you give TX-CERA permission to automatically charge your credit card for payment. You will receive an electronic receipt following your purchase, which you should retain for your records.

Our Refund Policy:
We will do everything within our ability and within reason to ensure your satisfaction. Refunds will not be issued for participation in Courses or Workshops already or partially completed or after access to the Course Content has been granted. Limitation of Liability:
In no event shall TX-CERA be liable for any injuries, harm, misuse of information, special, indirect, or consequential damages or any damages whatsoever resulting from loss of material, object, use, data, or profits, arising out of or in connection with the use or performance of any information posted on this Site.
Consent to Governing Law and Jurisdiction:
These Terms & Conditions, and any dispute arising out of it, shall be governed by the laws of the State of Texas.
You hereby consent to the exclusive jurisdiction and venue of any state court located in Texas in connection with any matter arising out of these Terms & Conditions, Privacy Policy, Disclaimer, or as a result of your use from the Site, Courses and/or Services.
Severability:
The provisions of these Terms & Conditions are severable, and the invalidity or unenforceability of any provision shall not affect the validity and enforceability of any other provision contained in this document.
